These Terms of Service (“Terms”) govern the provision of services by PlayForm (“we”, “us”, “our”) to the client (“Client”, “you”). By booking a service, you agree to these Terms.

1. Services

PlayForm provides on-site iPhone photo and video content creation services through contracted freelance creators. Services include on-site iPhone content capture, delivery of RAW photo and video files, and optional editing services (if purchased). Deliverables are limited to the package selected at time of booking. PlayForm reserves the right to assign any qualified contracted creator to fulfil the booking.

2. Independent Contractors

All creators engaged by PlayForm are independent contractors. They are not employees, partners, or agents of the Client. PlayForm manages scheduling, standards, and delivery coordination. The Client agrees that PlayForm may substitute creators at its discretion.

3. Booking & Payment

A booking is confirmed once PlayForm issues written confirmation of the scheduled shoot. Payment terms will be agreed in writing prior to the shoot date. PlayForm reserves the right to require full payment prior to delivery of any content. Additional services, add-ons, or extended hours not included in the original booking may be invoiced separately and are payable in accordance with the agreed terms.

4. Scope of Work

Services are limited to the agreed package duration and inclusions. Additional time beyond the booked session will be charged at the agreed hourly rate. Additional locations, concepts, or revisions outside the agreed scope may incur additional fees. PlayForm is not responsible for deliverables beyond the agreed scope.

5. Client Responsibilities

The Client agrees to provide clear shoot instructions and brief, ensure access to location at the scheduled time, provide necessary permissions for filming, and ensure products, talent, and props are ready at shoot time. Delays caused by the Client may reduce effective filming time and will not extend the session unless additional time is purchased.

6. Delivery

RAW content may be delivered on-site immediately following the shoot via AirDrop or cloud transfer, where practical. If immediate transfer is not possible, RAW files will be delivered via digital file transfer within the agreed timeframe. Edited content, including reels or other post-produced deliverables, will be delivered within the timeframe agreed in writing with the Client. Delivery is provided digitally. The Client is responsible for downloading and securely backing up all files upon receipt.

7. Intellectual Property & Usage

Upon full payment, the Client receives usage rights to the delivered content for organic and commercial use. If paid advertising usage rights incur an additional fee, those rights are only granted upon purchase. PlayForm retains the right to use content for portfolio, marketing, and promotional purposes unless otherwise agreed in writing. RAW project files (editing timelines, presets, internal materials) are not included.

8. Cancellations & Rescheduling

Rescheduling requires a minimum of 72 hours’ notice. Cancellations made within 72 hours of the shoot may result in forfeiture of the deposit. No-shows may be charged the full booking amount. Rescheduling due to weather or circumstances beyond reasonable control may be accommodated at PlayForm’s discretion.

9. Performance Disclaimer

PlayForm does not guarantee specific results, including views, engagement, conversions, or revenue. Platform performance is influenced by factors beyond PlayForm’s control.

10. Limitation of Liability

PlayForm’s total liability is limited to the total fees paid by the Client for the specific booking. PlayForm is not liable for indirect, incidental, or consequential damages.

11. Force Majeure

PlayForm shall not be liable for delays or failure to perform due to circumstances beyond reasonable control, including illness, government restrictions, extreme weather, or other unforeseen events.

12. Governing Law

These Terms are governed by the laws of Australia.
